The conditions of use are valid for all users (customers) of the TMMA CROSSBRAZE website, anonymous as well as registered, and are the exclusive basis for all transactions/business between the customer and TMMA CROSSBRAZE.

1. Prices

1.1 All prices for articles shown on the website of TMMA CROSSBRAZE do not include costs for shipping, possible charges for cash on delivery and/or additional charges.

1.2 All prices for articles shown on the website of TMMA CROSSBRAZE include the legal austrian value-added tax of 20%.

1.3 All prices for articles shown on the website of TMMA CROSSBRAZE are specified and cleared in EURO only.

1.4 Changes in prices of articles in particular are reserved and can be done at any time.

1.5 Discounts and rebates are subject to customers in special user-groups (defined by TMMA CROSSBRAZE) or may be granted due to special agreements only.

1.6 Special offers in the form of rebates or discounts are only valid as long as they are presented on the article-sites of the TMMA CROSSBRAZE website. Special offers can be closed at any time.

2. Payment

2.1 TMMA CROSSBRAZE accepts payments done via cash on delivery, EU standard bank transfer or PayPal.

2.2 Please find further information about the payment-types during the checkout-process or within the confirmation-mail of your order.

2.3 Possible costs for a payment-type are for the account of the customer. The customer is responsible for the correct processing of the payment until the receipt of payment at TMMA CROSSBRAZE.

2.4 The payment has to be done "immediately at chance", that is according to the instructions at PayPal, in the case of cash on delivery at delivery respectively pickup of the packet within 2 working days. In case of banktransfer the customer has to execute the payment within 4 working days.

2.5 TMMA CROSSBRAZE is able to recall / retain the ordered articles in case of late or missing payment and to cancel the order.

2.6 Ordered articles are the property of TMMA CROSSBRAZE until complete payment and receipt of payment.

3. Shipping

3.1 Please find information about delivery and shipping by clikcing the link "Delivery and shipping" on the website of TMMA CROSSBRAZE. The information is part of this conditions of use.

4. Guarantee

4.1 Basically TMMA CROSSBRAZE grants guarantee for unopen/shrinkwrapped articles only.

4.2 In the case of a claim TMMA CROSSBRAZE reserves the right to decide individually, if the claim is under guarantee or not. If an obvious manufacturing error occurred, guarantee will be granted (replacement). If damage is the result of malpractice, guarantee will be refused.

5. Right of withdrawal

5.1 From the time of transmission of the confirm-e-mail on an order is binding (independet of the fact, if the customer has received and read the e-mail; the timestamp stored at TMMA CROSSBRAZE is valid).

5.2 If the customer wants to cancel an order, this can be done by using the contact form and including your name, order number, article name, article price, article quantity and total sum in the message.

5.3 In the case of a cancellation of an order TMMA CROSSBRAZE reserves to charge / deduct an appropriate allowance, according to the status of the order and the caused effort up to that time.

5.4 If the order was already sent to the customer, the cancellation will be processed after returning and receipt of the unopen and unused articles at TMMA CROSSBRAZE only. If articles had been opened or used, the order will not be withdrawn.

5.5 If a refundment of an amount emerges from a cancelled order, the customer is responsible for the transmission of his/her banking/account data to TMMA CROSSBRAZE.

6. General

6.1 Austrian law is applied.

6.2 Court of jurisdiction is A-8570 Voitsberg.

6.3 If this GTC should be deemed to be invalid and/or ineffective in whole or in part, or any incompleteness may arise, other regulations remain unaffected. In lieu of the invalid and/or ineffective stipulation, the legal regulations as mentioned in 6.1 will apply, which come as close as possible to the economic intent of the invalid and/or ineffective regulation. The same is true for missing stipulations.
